Reliable Property Solutions LLC d/b/a RPS Appliance Repair

Customer shall mean the party and/or any person acting on behalf of the party that owns the property at the Service Address where repair services are performed.
The physical location where diagnostic or repair services are provided.
The individual or entity financially responsible for payment of services rendered.
Diagnostic, repair, maintenance, or related appliance services performed by Reliable Property Solutions LLC d/b/a RPS Appliance Repair (hereinafter referred to as “RPS Appliance Repair”).
Customer authorizes RPS Appliance Repair to perform diagnostic and/or repair services as requested at the Service Address. Authorization may be provided verbally, electronically, or in writing, including through digital work orders, invoices, or payment approval.
Customer acknowledges that services may be performed before or after written authorization is obtained and agrees that acceptance of services, authorization to proceed, or payment constitutes agreement to these Terms of Service.
Customer agrees to be responsible for all charges approved or incurred for services performed at the Service Address, unless payment responsibility is expressly assumed by a third-party Paying Party.
For services billed to third parties (including manufacturers, home warranty companies, or property managers), Customer remains responsible for payment if the Paying Party fails to remit payment for any reason.
Any dispute, claim, or controversy arising out of or relating to the services provided by RPS Appliance Repair, including but not limited to billing, workmanship, warranty issues, property damage, or the condition of the appliance, shall be resolved exclusively through binding arbitration and not in a court of law.
Customer and RPS Appliance Repair knowingly and voluntarily waive the right to a trial by judge or jury.
All disputes must be brought in an individual capacity only. Customer agrees not to bring or participate in any class, collective, representative, or private attorney general action against RPS Appliance Repair.
Arbitration shall be administered by the American Arbitration Association (AAA) or JAMS under their applicable consumer arbitration rules in effect at the time arbitration is initiated.
Arbitration shall take place in the state where the service was performed, unless otherwise agreed by the parties.
This arbitration agreement is governed by the Federal Arbitration Act and applicable state law based on the location where services were provided.
Customer may opt out of this arbitration agreement by providing written notice to RPS Appliance Repair within 14 days of the completion of service.

Opting out of arbitration does not affect service quality, warranty coverage, pricing, or the Customer’s relationship with RPS Appliance Repair.

To the fullest extent permitted by law, RPS Appliance Repair shall not be liable for any indirect, incidental, or consequential damages arising out of or related to the services performed, including but not limited to loss of use, loss of food, or property damage not directly caused by gross negligence.
These Terms of Service govern service authorization, payment responsibility, and dispute resolution. Warranty coverage is governed separately by the RPS Appliance Repair Warranty Terms, which are incorporated by reference but remain a distinct policy.
By authorizing services, signing a work order, making payment, or accepting services performed by RPS Appliance Repair, Customer acknowledges and agrees to these Terms of Service.
